Information on how to enter the Promotion forms part of these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified.

Section 1: Promotion
1. Promotion: Complete and submit the Accor Advantage Plus Enquire and Win online enquiry form or purchase an Accor Advantage Plus membership online at http://www.advantageplus.com.au or www.advantageplus.co.nz between 16 September 2008 and 31 January 2009 and the entrant will go into the draw to win return economy flights to Melbourne for two (2) people, four (4) nights' accommodation in a studio apartment at Grand Hotel Melbourne, a member of the MGallery Collection, breakfast for two (2) people daily and two (2) A-Reserve tickets to Wicked, the Untold Story of the Witches of Oz, playing at the Regent Theatre in Melbourne.

2. Promoter: AAPC Limited (ABN 87 009 175 820) of Level 30, Angel Place, 123 Pitt Street, Sydney, NSW, 2000.

3. Promotion Period: The Promotion will commence at 12.00 am on 16 September 2008 and will close 11.59 pm on 31 January 2009. All times recorded throughout these terms and conditions are in Australian Eastern Standard Time.

Section 2: Eligibility
4. Eligibility: To be eligible to enter the Promotion, the entrant must:

  1. be above 18 years of age; and
  2. be an Australian or New Zealand resident; and
  3. complete and submit the Accor Advantage Plus Enquire and Win online enquiry form located at www.advantageplus.com.au or www.advantageplus.co.nz with all details requested on the form during the Promotion Period, or purchase an Advantage Plus membership online at www.advantageplus.com.au or www.advantageplus.co.nz during the promotion period.

5. Non-Eligibility: Entrants are not eligible to enter the Promotion or win any Prize if they are a director or manager, an employee or immediate family member of an employee of the Promoter, or an employee of their agencies associated with the Promotion.

6. Further , any personal information or contact details entered incorrectly on the online enquiry form or any subsequent cancellation of an Accor Advantage Plus membership purchased online shall deem the entry as an invalid entry.

Section 3: Entry to the Promotion
7. When an eligible entrant completes and submits the Accor Advantage Plus Enquire and Win online enquiry form located at www.advantageplus.com.au or www.advantageplus.co.nz, within the Promotion Period as noted in Clause 3, the entrant will automatically receive one (1) entry to the Promotion. Only one (1) entry may be made per person and multiple entries are not permitted. For the entry to be valid, the entrant:

  1. Agrees and authorises to receive a telephone call on the telephone number provided on the online enquiry form from an Accor agent promoting Accor Advantage Plus Sales to discuss the benefits of the Accor Advantage Plus Program; or
  2. Agrees and authorises the credit card used by the applicant to purchase a membership online to be charged for the applicable annual membership fee.

Section 4: Draw
8. Draw: A representative of the Promoter will conduct a random draw of all submitted entries at 11.00 am on 6 February 2009 at 5/15 Grosvenor Street, Neutral Bay, NSW 2089. The Prize Winner will be selected at random from a computer-generated listing of entries that comply with Section 2 and 3 of these terms and conditions over the Promotion Period.

9. Prize Winner: The Prize described below in Section 5 will be awarded to the first valid entry drawn as described in Clause 8.

Section 5: Prize
10. Prize Components: There is one (1) Prize to be awarded in this Promotion consisting of the following:

  1. Return economy flights for two (2) people from the prizewinner's nearest capital city in Australia (if the winner is a resident of Australia) or New Zealand (if the winner is a resident of New Zealand) to Melbourne (valued at up to: AU$2035.00)
  2. Four (4) nights' accommodation for up to two (2) people in a Studio Apartment at Grand Hotel Melbourne, (valued at up to: AU$1116.00).
  3. Breakfast daily for up to two (2) people (valued at up to: AU$184.00)
  4. Two (2) A-Reserve tickets to Wicked, the Untold Story of the Witches of Oz, playing at the Regent Theatre in Melbourne. (valued at up to: AU$265.00)

11. Prize Value: The total value of the Prize to be won during the Promotion is valued at up to AU $3600.00, inclusive of GST. In the case that the winner is a Victorian resident the winner will forfeit the airfare portion of the prize and no compensation or cash will be given in leiu. The total value of the Prize to be won, if the winner is from Victoria is valued at up to AU $1565.00, inclusive of GST.

12. Prize Conditions: The Prize is subject to the following conditions:

  1. No exchange of Prize: The Prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and he/she does not wish to transfer the Prize, then the Prize will be forfeited.
  2. Ancillary Costs: All transport, meals, beverages, spending money, insurances, service charges, taxes, transfers and ancillary costs, including cost of travel to and from the property are not included in the Prize unless specified and are the responsibility of the Prize Winner.
  3. Taxes: If the Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax.
  4. Prize Availability: All components of the Prize, including flights and accommodation are subject to availability, and may not be available during school holidays, holiday weekends, or special events. In the event that any component of the Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that Prize component with another prize of equal value and the Prize Winner will be notified accordingly.
  5. Date Prize to be Taken: The Prize Winner must travel and utilise the Prize by 31 July 2009.

Section 6: Prize Winner
13. Contact: The Promoter will contact the Prize Winner in writing by mail or email and telephone on 9 February 2009 to confirm his/her eligibility under these terms and conditions and to confirm whether the Prize Winner wishes to claim his/her Prize. The name of the Prize Winner will also be published in the Public Notices section of The Australian on 16 February 2009.

14. Claim of Prize: If the Prize Winner wishes to claim the Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these terms and conditions by 10.00 am on 11 May 2009. If the Prize Winner fails to do either or both of these things by the deadline, the Prize Winner will be deemed to have forfeited the Prize.

15. Redraw: Subject to any written directions given under Reg. 37 of the Lottery and Gaming Regulations (SA) or other applicable law, in the event that a Prize remains unclaimed, the Promoters will conduct a redraw, following the same procedure and format as set out under the Section 4 above. The redraw will take place at 11.30 am on 22 May 2009 at the same place as the original draw described in Clause 8.

16. Redraw Winner: The name of the Prize Winner from any redraw will be published in The Australian on 29 May 2009. In the event that this redrawn Prize Winner is not eligible, the Promoters will conduct a redraw until the Prize is awarded (subject to any further regulatory directions).

17. Winner Publicity: In accepting the Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their name, address and photographs without any payment being made to them in respect of this Promotion.

Section 7: General Conditions
18. Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.

19. Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winner, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

20. Force Majeure: Subject to State legislation the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.

21. Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.

22. Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to entrants. This may include, but is not limited to, the names, email addresses, telephone numbers and credit card details of the entrants, provided by the entrant on the online enquiry form, registration form or when paying for services provided by the participating Hotel. The entrant's personal information is collected so the Promoter is able to conduct the Prize Draw and to contact and award the Prize to the Prize Winner, to publish the results of the Promotion and to publicise the Promotion.

23. Consent to use of Personal Information for Marketing Purposes:Furthermore, by entering this Promotion, unless otherwise advised by the entrant, each entrant consents to the retention and use of the information collected pursuant to Clause 22 by the Promoter, which trades as Accor Asia Pacific and the Accor Group. For details about who we are, how we may use your information and what your rights are under the new privacy laws, please see our Privacy Policy, which is available from the Promoter at the address provided in Section 1, Clause 2 or online at http://www.accorhotels.com.au/privacy. Uses may include future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant, or distribution of marketing materials for goods or services in the tourism, hospitality and services industries from the Accor Group or from companies in the tourism and hospitality industry in which the Promoter holds shares.
